Welcome to gibLink! These Terms of Service (“Terms”) govern your access to and use of the gibLink website, mobile application, community platform, courses, podcasts, and all related services (collectively, the “Platform”). Please read these Terms carefully before using the Platform. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

1. Account Creation and Eligibility:

• You must be at least 18 years old to create an account and use the Platform.
• You are responsible for maintaining the confidentiality of your account information, including your password.
• You agree to provide accurate and complete information when creating your account and to keep your information updated.
• You are responsible for all activity that occurs under your account.
• gibLink reserves the right to refuse service, terminate accounts, or remove or edit content in its sole discretion.

2. Subscription and Payment:

• Subscription Fees: Access to the gibLink Platform is provided through a recurring subscription (monthly or annual) or through the purchase of a lifetime access “Founding Member” plan (available for a limited time).
• Pricing: Current subscription pricing and Founding Member offer details are available on our Pricing page. gibLink reserves the right to change pricing at any time, with prior notice to existing subscribers.
• Payment: You authorize gibLink to charge your chosen payment method for all applicable fees.
• Automatic Renewal: Subscriptions will automatically renew at the end of each billing cycle unless you cancel your subscription before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle. No refunds will be provided for partial billing periods, except as outlined in our Refund Policy.
• Founding Member Access: The Founding Member plan provides lifetime access to the platform, subject to these Terms of Service. Lifetime access refers to the lifetime of the gibLink platform.
• Free Course: We provide a free introductory course.

3. Refund Policy:

• Please refer to our separate Refund Policy for details on eligibility and procedures for requesting refunds.

4. Intellectual Property:

• Ownership: All content on the Platform, including but not limited to courses, text, videos, audio, images, graphics, code, and the Link AI assistant, is the property of gibLink or its licensors and is protected by copyright, trademark, and other intellectual property laws.
• Limited License: gibLink grants you a limited, non-exclusive, non-transferable license to access and use the Platform and its content for your personal, non-commercial learning purposes, subject to these Terms.
• Restrictions: You may not:
  • Copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the content on the Platform, except as expressly permitted by these Terms.
  • Use any automated means (e.g., robots, spiders, scrapers) to access or collect data from the Platform.
  • Share your account login information with others.
  • Attempt to circumvent any security measures on the Platform.
  • Use the Platform for any illegal or unauthorized purpose.

5. Community Guidelines:

• The gibLink AI community is a place for respectful and constructive interaction. You agree to abide by our Community Guidelines [Link to Community Guidelines], which prohibit:
  • Harassment, bullying, or discrimination.
  • Spamming or self-promotion (outside of designated areas).
  • Posting illegal or infringing content.
  • Sharing confidential information.
  • Violating the privacy of other users.
• gibLink AI reserves the right to remove any content or suspend any account that violates these guidelines.

6. Affiliate Program (Partner Program):

• If you participate in the gibLink Partner Program, you agree to be bound by the separate Affiliate Program Terms and Conditions .

7. Disclaimer of Warranties:

• THE PLATFORM AND ITS CONTENT ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. GIBLINK AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. GIBLINK AI DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• GIBLINK AI DOES NOT GUARANTEE RESULTS.

8. Limitation of Liability:

• TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GIBLINK AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (C) ANY CONTENT OBTAINED FROM THE PLATFORM; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT GIBLINK AI HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

9. Governing Law and Dispute Resolution:

• These Terms shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles.
• Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration.

10. Changes to Terms:

• gibLink AI reserves the right to modify these Terms at any time. We will post the updated Terms on the Platform and update the “Last Updated” date. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
